1. ABOUT THESE TERMS

These Terms and Conditions apply to your use of the Opportunity XI website and the services we provide.

Opportunity XI helps football players explore opportunities to play football and study in the United States. Our services may include player applications, assessment events, consultations and, where agreed separately, player representation and recruitment support.

By using this website, submitting an application or booking an Opportunity XI service, you agree to these Terms and Conditions.

2. APPLICATIONS

Players may submit an application to Opportunity XI through our website or another application method we provide.

Submitting an application does not guarantee an invitation to an assessment event, acceptance as an Opportunity XI player, representation, a college opportunity or a scholarship.

You agree that the information you provide in your application is accurate and complete to the best of your knowledge. If your circumstances or information change, you should let us know where relevant.

For players under 18, we may require a parent or guardian to be involved in communications, bookings, consents or agreements.

3. ASSESSMENT EVENTS

Opportunity XI may invite players to attend an assessment event. Where an assessment event has a fee, the price will be clearly stated before you make a booking.

Payment for an assessment event secures your place at that event, subject to availability and these Terms and Conditions.

Attending an assessment event does not guarantee that Opportunity XI will offer representation or recruitment services, and it does not guarantee a college place, scholarship or other opportunity in the United States.

Players are expected to follow reasonable instructions from Opportunity XI staff and coaches and to behave appropriately during an assessment event.

4. CANCELLATIONS, TRANSFERS AND REFUNDS

If you cancel your assessment event booking at least 7 days before the event, you may request either a refund or a transfer to another available Opportunity XI assessment event.

If you cancel less than 7 days before the event, the assessment fee will normally be non-refundable. Opportunity XI may, at its discretion, allow your booking to be transferred to another event in exceptional circumstances.

If you do not attend an assessment event without notifying us, the assessment fee will not normally be refunded or transferred.

If Opportunity XI cancels an assessment event, you will be offered either a full refund of the assessment fee or the option to transfer your booking to another available event.

If Opportunity XI reschedules an event and you cannot attend the new date, you may request a full refund of the assessment fee.

Nothing in these Terms affects any rights you have under applicable consumer law.

5. ASSESSMENT OUTCOMES

Following an assessment event, Opportunity XI may provide feedback and inform you whether we wish to discuss the next stage of the Opportunity XI process with you.

An invitation to continue to the next stage does not guarantee representation, recruitment by a college, admission to a college, a place on a football programme or a scholarship.

Opportunity XI makes assessment decisions based on the information and performance available to us at the relevant time. We are not required to offer representation or further services to every player who applies or attends an assessment event.

6. REPRESENTATION AND RECRUITMENT SERVICES

If Opportunity XI offers you the opportunity to use our representation or recruitment services, those services will be subject to a separate agreement.

Any services, fees, payment terms and responsibilities relating to representation or recruitment will be explained before you enter into that agreement.

Paying for or attending an assessment event does not automatically enter you into a representation agreement with Opportunity XI.

Opportunity XI cannot guarantee that a player will receive interest from a particular college, receive an offer, secure a scholarship or ultimately be placed with a college in the United States.

7. YOUR RESPONSIBILITIES

You are responsible for providing Opportunity XI with information that is accurate, complete and not misleading.

You should tell us if relevant information changes while you are using our services.

You are responsible for responding to reasonable requests for information and for meeting any deadlines that are communicated to you as part of a service you have chosen to use.

Players attending an Opportunity XI event are responsible for ensuring that they are appropriately equipped to participate and for following reasonable safety instructions given by event staff, coaches or venue staff.

For players under 18, Opportunity XI may require a parent or guardian to provide consent or enter into agreements on the player’s behalf where appropriate.

8. PHOTOGRAPHS AND VIDEO

Opportunity XI may photograph or record assessment events for assessment, player development, recruitment or promotional purposes.

Where photographs or video are intended to be used for marketing or promotional purposes, Opportunity XI will obtain any consent required before using that material.

Players may also choose to provide Opportunity XI with football footage or links to footage. By providing this material, you confirm that you have the right or permission to share it with us for the purposes of providing our services.

9. INTELLECTUAL PROPERTY

The Opportunity XI name, logo, branding, website content, documents, assessment materials and other materials created by Opportunity XI are owned by us or used with permission.

You may use our website and materials for your own personal use in connection with Opportunity XI’s services.

You must not copy, reproduce, distribute, publish, sell or use Opportunity XI materials for commercial purposes without our prior permission.

Nothing in these Terms transfers ownership of Opportunity XI’s intellectual property to you.

10. THIRD-PARTY SERVICES AND WEBSITES

Opportunity XI may provide links to third-party websites or refer you to colleges, coaches, organisations or other service providers.

These third parties operate independently from Opportunity XI. We are not responsible for the content, availability or practices of third-party websites or services.

Any decision to use a third-party service or enter into an agreement with a third party is your responsibility and may be subject to that third party’s own terms and conditions.

11. CHANGES TO OUR SERVICES

Opportunity XI may make reasonable changes to our website, assessment events or services from time to time.

We may change an event venue, schedule, format, coach or other event arrangements where reasonably necessary.

Where a significant change affects a service you have already booked, we will provide you with appropriate information and, where applicable, the options available to you.

We may also update these Terms and Conditions from time to time. The latest version will be published on our website with the date it was last updated.

12. LIABILITY

Opportunity XI will provide its services with reasonable care and skill.

We do not guarantee any particular football, college, recruitment, scholarship or other outcome from using our services.

Opportunity XI is not responsible for losses caused by circumstances outside our reasonable control or by inaccurate or incomplete information provided to us.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these Terms affects your statutory rights as a consumer.

13. PRIVACY AND PERSONAL INFORMATION

Opportunity XI will handle personal information in accordance with our Privacy Policy and applicable data protection law.

Our Privacy Policy explains what information we collect, how we use it, who we may share it with and the rights available to you in relation to your personal information.

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer, you may also have rights under the laws that apply where you live.

Any dispute relating to these Terms or our services will be dealt with by the courts that have jurisdiction under applicable law.
